PFAS, Heavy Metals & Contamination Expert Witness

Ethan Alden-Danforth, PhD — Cosmetic & OTC Personal Care Products

I provide expert witness services for litigation involving PFAS (per- and polyfluoroalkyl substances), heavy metals, microbial contamination, and other chemical or physical adulterants in cosmetic and OTC personal care products. These matters require an expert who can bridge formulation chemistry, analytical testing methodology, regulatory standards, and manufacturing practice — a combination that defines my professional background.

PFAS and heavy metal contamination in cosmetics has become one of the most active litigation areas in the personal care industry, driven by third-party testing studies, consumer class actions, and increasing regulatory scrutiny. My chemistry training and industry experience allow me to evaluate the source of contamination, assess the adequacy of manufacturer testing programs, and analyze causation and consumer exposure in a litigation context.

Litigation Areas

PFAS in Cosmetics
Analysis of PFAS contamination sources (intentional use vs. incidental presence), analytical testing methodologies, applicable regulatory limits, and manufacturer liability in PFAS class actions and individual claims.
Heavy Metals
Expert review of lead, arsenic, cadmium, mercury, and other heavy metal contamination in cosmetics — including raw material sourcing, testing protocols, and compliance with California Prop 65, FDA limits, and industry standards.
Microbial Contamination
Analysis of microbial failures including Pseudomonas, Burkholderia, and other opportunistic pathogens in water-based formulations, preservation system adequacy, and challenge testing methodology.
Analytical Testing Disputes
Evaluation of third-party testing methodologies, laboratory protocols, chain of custody, detection limits, and the scientific validity of test results used in litigation.
Preservative & Stability Failures
Review of preservative efficacy testing, stability protocol design, and formulation decisions that contribute to contamination risk during shelf life.
Raw Material & Supply Chain Liability
Analysis of contamination introduced through raw material suppliers, contract manufacturers, or packaging components, and allocation of liability across the supply chain.

Qualifications

I hold a PhD in Organic Chemistry from Johns Hopkins University and serve as Vice President of R&D for a cosmetic contract manufacturer. My technical background in organic and analytical chemistry, combined with hands-on experience managing raw material qualification, stability programs, and finished product testing in a GMP manufacturing environment, provides a strong foundation for expert analysis in contamination matters.

I have reviewed analytical testing data, interpreted third-party laboratory reports, and evaluated manufacturer quality systems in the context of litigation. I am familiar with the testing methodologies commonly used in PFAS and heavy metals litigation, including ICP-MS, ICP-OES, and LC-MS/MS techniques.
