Contract Manufacturing Disputes Expert Witness

Ethan Alden-Danforth, PhD — Cosmetic & OTC Personal Care Products

I provide expert witness services for commercial disputes arising from cosmetic and OTC personal care contract manufacturing relationships. As a senior executive at a cosmetic contract manufacturer with over 15 years of industry experience, I have an insider's understanding of how contract manufacturing agreements are structured, what obligations they create, and how disputes arise across formulation, production, quality, and delivery.

Contract manufacturing disputes in the cosmetics industry frequently involve technical questions that require expert analysis — whether a batch was manufactured to specification, whether a GMP deviation caused the alleged defect, whether the formulation transferred correctly from development to commercial scale, or whether the manufacturer's quality system was adequate. I provide technically grounded, litigation-ready opinions on these and related questions for both plaintiff and defense counsel.

Litigation Areas

GMP & Quality System Failures
Analysis of deviations from Good Manufacturing Practice, inadequate quality systems, batch record failures, and out-of-specification product in the context of contract manufacturer liability.
Formulation & Scale-Up Disputes
Expert review of formulation transfer, scale-up failures, batch-to-batch variation, and disputes over whether commercial production met development specifications.
Supply & Delivery Failures
Analysis of production delays, short shipments, substitution of raw materials or components, and breach of supply agreement obligations.
Private Label & Proprietary Formula Disputes
Review of intellectual property, formula ownership, confidentiality obligations, and unauthorized disclosure or use of proprietary cosmetic formulations.
Raw Material & Ingredient Disputes
Expert analysis of approved supplier programs, raw material substitution, adulteration, certificate of analysis disputes, and incoming quality control failures.
Contamination & Recall Liability
Allocation of responsibility between brand owner and contract manufacturer for contamination events, recalls, and resulting consumer harm or regulatory action.

Qualifications

I hold a PhD in Organic Chemistry from Johns Hopkins University and currently serve as Vice President of R&D for a cosmetic contract manufacturer. I have direct operational experience on both sides of the contract manufacturing relationship — as an R&D executive at a CMO responsible for formulation development, scale-up, GMP compliance, and client deliverables. This gives me a uniquely practical perspective on where contract manufacturing relationships break down and how to analyze responsibility when they do.

I have prepared expert witness opinion reports and provided deposition testimony for both plaintiff and defense counsel in state and federal litigation involving manufacturing disputes.
